This document is an electronic record in terms of Information Technology Act, 2000, amendments thereof from time to time and the rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
The website mewt.in and mewt mobile application (jointly “App”) are owned and operated by mewt account private ltd. (“mewt account private ltd.”) a company incorporated under the provisions of the Companies Act, 2013, and having its registered office at 1st FLOOR, 138/12, 4TH MAIN ROAD, INDUSTRIAL TOWN, RAJAJINAGAR, BANGALORE, KA, 560044.
To access or use the App by mewt account private ltd on any compatible device you are required to accept following Terms and Conditions (“T&C”).These terms constitute a legally binding agreement between you and mewt account private ltd. governing your access to and use of the services provided by mewt account private ltd . If you do not understand these documents or do not accept any part of them, then you should not use any services provided by mewt account private ltd.
You further understand and agree that mewt account private ltd reserves the right to update any of these Terms and conditions from time to time.Your access and use of the App following any such change constitutes your agreement to follow and be bound by these T&C, as updated or modified. You must ensure that you keep yourself up-to-date and read the Terms and conditions at close intervals.By accepting these Terms of Use, You also accept and agree to be bound by our Entity Policies (including but not limited to Privacy Policy) as amended from time to time.
“Users” means anyone who uses or accesses the App on any computer, mobile phone, tablet, console or other device (collectively, “Device”)
“we”, “our” ,”Mewt” and “us” mean mewt account private ltd.
“you” and “your” mean a User who meets the eligibility criteria set out below
“Mewt App” means app provided by mewt account private ltd.
All other financial terminologies used hereafter will refer to or will be in accordance to the Payment and Settlement Systems Act, 2007
By accepting the Terms and conditions you represent and warrant the following:
Your rights and preferences as a data subject in India. These T&C are intended for Users within the territory of India and govern your rights as per applicable law within the territory of India. However, in the event you fall under a jurisdiction outside the purview of Indian law, we will not be liable for any claim, action and/or right initiated/exercised by you as per the extant laws of that jurisdiction. Therefore, we ask you to kindly use the App accordingly.
Mewt (pronounced as mute) is a supercharged bank account for SMEs of India where they can combine all their accounts in one place and make real time funds transfers without any limit or having to wait for a cooldown period on adding the beneficiary and also earn upto 1% cashback on supercharge card spends as and when applicable. mewt is bringing privileged banking to the underserved MSMEs & trying to make missed-EMIs history.
Through our services , you may send payments to service providers, Users, Merchants, Billers or third parties using any Payment Instruments accepted by us. You may also receive payments from other Users or third parties in the Payment Instrument you designated in our app.
We may facilitate provision of third party products or services to you within our app. These third party products or services are offered by parties other than mewt account private ltd, and are subject to third party terms. You may need to accept additional terms and conditions and meet additional requirements to use these third party services. We will not be responsible or liable to you for any loss incurred by you as a result of your interaction with a third party product or service on Mewt App.
Mechanics of Payment Transaction
The Payment Transactions through our app are solely between the Sender and Recipient of the payment. We create a link between the Sender, the Recipient and the respective Payments System Providers to facilitate sending and/or receiving payments using Payments System Provider Services. We have no role in the delivery of service or any other modality associated with it except - to facilitate transfer of funds. Once a Payment Transaction has been authenticated, authorized and processed through the Payments System Provider Services:(i) the payment may be settled directly with the Recipient by the respective Payments Participants; or(ii) in certain scenarios, we may act as an intermediary and receive funds pertaining to the Payment Transaction on behalf of the Recipient. In such scenarios, we would operate purely as the Recipient’s payment collection agent for the limited purpose of accepting funds from Users.
Our role in Payment Transactions
You understand and agree to the following:
Age Restrictions. You must be 18 years of age or older, in order to use our services.If you allow anyone to use your mewt account, including individuals under 18 years of age, you will be responsible for ensuring that such individuals comply with our Terms and Conditions . You will be responsible for all actions these individuals take in and/or through your mewt account .
Territorial Restrictions. To use services provided by us , you will need to be physically located in India when registering or linking your mewt account, have an Indian bank account and an Indian mobile number. The Mewt App should not be used outside of India.
Basic Requirements. You will need a mobile, internet or any other supported device ("Device") that meets certain system and compatibility requirements with the following minimum specifications: Android Operating System version 5.1 (SDK level 16) or higher . These requirements may change from time to time to use services provided by us . Your ability to use our services affected by these factors. You agree that you are responsible for such requirements, including any applicable changes, updates, fees and all other terms provided under your agreement with your mobile device and telecommunications provider. We will not be responsible for any lapse of security or failed Transactions due to your internet or Device service provider.
Updates. You may need to install updates to your Mewt App that we introduce from time to time to access, use, or continue to use our services. Your use of our app requires that you have agreed to receive automatically requested Updates. If you do not agree to such automatically requested Updates, then please do not use the App.
You agree to indemnify, defend and hold harmless Mewt, the Payment Participants, and its and their directors, officers, owners, agents, co-branders or other partners, employees, information providers, licensors, licensees, consultants, contractors and other applicable third parties (collectively "Indemnified Parties") from and against any and all claims, demands, causes of action, debt or liability, including reasonable attorney fees, including without limitation attorneys fees and costs incurred by the Indemnified Parties arising out of, relating to, or which may arise from:
During the login/registration process or anytime thereafter, you may be asked to provide information such as your name, phone number, Payment Instrument information (including, but not limited to, your bank name and bank account number, credit card/debit card details, if applicable), date of birth, and officially verified documents. We may verify your registration information with a Payment Participant, service provider, and/or Third Party Provider, as defined below. In some cases, we may ask you to send us additional information/documentation or to answer additional questions (before or after your mewt account has been activated) to help us verify your identity or the accuracy of the information you provided. The provision and use of such data is subject to the Mewt Privacy Policy. We may deny your use of the Mewt Services, if we are unable to verify that the accuracy or completeness of the information and documentation you provided or we determine that you are not eligible to use our services , pursuant to our Terms and Conditions
You have an option to set a security passcode on the App once you are approved for a credit limit. You are responsible for maintaining the confidentiality of the passcode and your account (“Account”) and are fully responsible for all activities that occur under your passcode or Account. You agree to: (a) immediately notify us of any unauthorized use of your passcode or Account or any other breach of security; and (b) ensure that you exit from your Account at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to comply with this Clause.
You agree to indemnify, defend and hold harmless Mewt, the Payment Participants, and its and their directors, officers, owners, agents, co-branders or other partners, employees, information providers, licensors, licensees, consultants, contractors and other applicable third parties (collectively "Indemnified Parties") from and against any and all claims, demands, causes of action, debt or liability, including reasonable attorney fees, including without limitation attorneys fees and costs incurred by the Indemnified Parties arising out of, relating to, or which may arise from:
Accuracy of Information. You understand and agree that you are responsible for the accuracy of the information and documents you provide while registering on the app .You authorize mewt to make enquiries as we may feel necessary to satisfy itself about the validity of Your identity. You undertake to update us in case of change of Your existing information or verification documents provided by You.
We may employ third-party service providers and individuals due to the following reasons:
You acknowledge that the third-party service provider/agent/agencies will have access to your Personal Information on a need basis to assist us in rendering service, and the service providers are restricted from using the same for any other reason. The third-party service providers are obligated not to disclose or use the information for any other purpose.
Through the App, mewt account private ltd. assists Users to gain access to certain credit schemes from its banking and financial partners.The App provides inter alia a combination of the following facilities to its visitors:
Limitations on the Use of the Mewt Service. We or Payment Participants may establish general practices and limits concerning the use of Mewt App. We reserve the right to change, suspend or discontinue any aspect of Mewt App at any time, including hours of operation or availability of Mewt Services, without notice and without liability. We also reserve the right to impose limits on certain features or restrict access to parts or all of the service without notice and without liability. We may decline to process any Payment Transaction without prior notice to Sender or Recipient. We also reserve the right to automatically block any communication received by a User from a non-Mewt account, including any payment requests, that we deem to be spam or fraudulent communication.
We do not warrant that the functions contained in Mewt App will be uninterrupted or error free, and we shall not be responsible for any Service interruptions (including, but not limited to, power outages, system failures or other interruptions that may affect the receipt, processing, acceptance, completion or settlement of Payment Transactions).
Transaction Records Records of your Transactions will be reflected in your conversation history and Transaction history in your Mewt App. You are responsible for reviewing your Transaction activity to determine if there are any errors or unauthorised Transactions, and for alerting Mewt of such event.
Transacting with Virtual Account Numbers. When you initiate a Virtual Account Number payment or transit transaction using Mewt App, we may pass details of your Virtual Account Number and related information to the transacting party so that it can charge your payment method. A Virtual Account Number transaction may be initiated when you: use tap-and-pay in stores or on transit services using NFC, scan barcodes, or QR codes, or other contactless technology.
After passing the payment method and other details to the third party, Mewt will have no further involvement in the transaction as between you and the third party, and you acknowledge and agree that such transaction is solely between you and the third party and not with Mewt or any of its affiliates. You should contact the third party or your payment method provider (for example, the issuer of your Payment Instrument) directly regarding any issues with Virtual Account Number transactions, including refunds and disputes.
You acknowledge that Mewt may receive transaction information, including transaction location information, from your payment method’s issuer to display richly formatted transaction details and your recent transaction history in Mewt App.
Permissible Transactions. You may only use Mewt Services to process a Transaction to make payment for legitimate and bona fide purposes including purchase of goods and services. You may not use Mewt Payment Service to process Payment Transactions in connection with the sale or exchange of any illegal goods or services or any other underlying illegal Transaction.
You agree that you will not use the Mewt Service to process Transactions that violate the Mewt terms and conditions , All Mewt policies and Applicable Law or other policies or rules applicable to Mewt Services. Failure to comply with the Mewt policies and the restrictions thereunder may result in rejection of your Transaction or suspension or termination of your use of Mewt services.
As Business Pages , you will not use the Business Pages (a) for illegal purposes, or in support of illegal activities; (b) to promote or facilitate an unlawful transaction or the sale or exchange of any unlawful or prohibited products or services; (c) in connection with content or activities that are deceptive or that are prohibited (d) in any way that suggests that your activity is endorsed by Mewt ; (e) in any way that may damage Mewt’s reputation or goodwill; or (f) on in any way that is not compliant with the Applicable Law.
Mewt will reserve the right to stop/block or suspend any account with illegal or suspicious activity without any prior notice.
Mewt may invite you to participate in any offer from time to time. You agree that participating in such an offer is subject to your agreement to the respective offer terms and conditions. You further agree that offers provided to any user may vary from user to user.
Offers provided to you by Merchants or Billers on Mewt App are between you and the Merchant or Biller, Mewt is not responsible for the content of such Offers or for the fulfilment of such offers.
Mewt reserves the right to disqualify You from any offer in case you do not meet the eligibility criteria for such an offer or any other reasons thereof including but not limited to misuse of offer, misrepresentation, fraud or suspicious transactions/activities, including but not limited to PMLA directives or any at our sole discretion without further notice.
Refunds and Chargebacks. All Transactions processed through the Mewt Services are non-refundable to the Sender by Mewt and are non-reversible by the Sender through the Mewt Services. You may have additional refund or chargeback rights under your Payment Instrument issuer agreement or under applicable regulations. You should review the statements you receive from the issuer of your Payment Instrument which should reflect all Transactions through the Mewt Services.
In the event that the Sender’s Payment Instrument issuer requests a chargeback for a Transaction, Mewt reserves the right to reverse the Transaction amount. Mewt further retains the rights to set-off any chargeback amount from subsequent payments to be transferred to the Recipient.
Disputes. You understand that a payment Transaction is solely between the Sender and the Recipient and Mewt does not provide any guarantees or warranties with respect to any User, Biller, Merchant, third party or any service, good or delivery level commitment provided by such User, Biller, Merchant or third party. Use of Mewt Services in no way represents any endorsement by Mewt of any User, Biller, Merchant or third party. You should ensure that you have undertaken adequate due diligence prior to transferring payments to anyone using Mewt Services. Any dispute is between the Sender and Recipient without making Mewt and/or the Payments System Providers, a party to such disputes. However, in relation to UPI Payment Transactions, we are responsible for facilitating grievances / complaints resolution for Users. We shall be the first point of contact for all UPI Payment Transaction related grievances/complaints for Users. In case the complaint or grievance remains unresolved, the next level for escalation will be the PSP, followed by the Customer’s Bank and lastly NPCI. After exercising these options you can approach the Banking Ombudsman and or the Ombudsman for Digital Complaints, as the case may be.
Mewt is not obligated to mediate disputes between Senders and Recipients or between the Sender/Recipient and the Payment Participants. However, Mewt will assist Users in communicating with each other regarding a dispute or in sending the User’s complaint to the respective Payment Participant, if required under Applicable Laws or Payment Participant Rules. In the event of any complaints regarding Mewt Services, please contact Mewt and we will work with you to resolve it, where possible.
Waiver and Release. You agree to release Mewt and their agents, contractors, officers and employees, from all claims, demands and damages (actual and consequential) arising out of or in any way connected with a dispute. You agree that you will not involve Mewt in any litigation or other dispute arising out of or related to any transaction, agreement, or arrangement with any Recipient, Sender, advertiser or other third party in connection with the Mewt Service. If you attempt to do so, (i) you shall pay all costs and attorneys' fees of Mewt and shall provide indemnification as set forth below, and (ii) the jurisdiction for any such litigation or dispute shall be limited as set forth below. However, nothing in these Terms shall constitute a waiver of any rights, claims or defenses that you may have with respect to a Payment Transaction under the respective Payment Participants Rules or Applicable Laws.
In consideration of mewt account private ltd. granting you the rights hereunder, you hereby agree not to use the App for any purpose that is unlawful under any applicable laws and/or in violation of the terms of these T&C and our Privacy Policy. You shall not use the App in any manner that could damage, disable, overburden, or impair our server, or any network(s) connected to any server, or interfere with any other party’s use and enjoyment of the App. You shall not attempt to gain unauthorized access to any functions and features, other user accounts, computer systems or networks connected to any server, in any manner, including, through hacking, password mining or any other means. You shall not obtain or attempt to obtain any materials or information through any means which is not intentionally made available through the App.
The App is made available to you for your own personal and non-commercial use alone. You shall not allow third parties to: (i) make and/or distribute copies of the App or any deliverable generated by the App; (ii) attempt to copy, reproduce, alter, modify and/or reverse engineer the App; and/or (iii) create derivative works of the App.
You accept that any and all operations emanating from your Device shall be assumed to have been initiated by you.
You shall request mewt account private ltd., to block the Account and change the passcode immediately for the Account, if your Device has been lost or stolen.
You are responsible for any and all activities that occur in your Account. You agree to notify mewt account private ltd. immediately of any unauthorized use of the Account or any other breach of security. mewt account private ltd. shall not be liable for any loss to you or your organization owing to negligent actions or a failure on your part to inform mewt account private ltd., within a reasonable time, about loss or theft of your Device and/or any unauthorized access in your Account, either with or without your knowledge.
You shall be liable for losses incurred by mewt account private ltd. or any other party due to a third party’s use of the Account. You shall not use any other person’s account at any time, without the permission of the account holder and mewt account private ltd..
Mewt account private ltd. shall make all reasonable efforts to ensure that your information is kept confidential. However, mewt account private ltd. shall not be responsible for any disclosure or leakage of confidential information and/or loss or damage of the Device due to theft, negligence or failure on your part to practice safe computing.
You shall ensure that while using the functions and features, all prevailing and applicable laws, rules and regulations, shall at all times, be strictly complied with by you and Mewt account private ltd. shall not be liable in any manner whatsoever for default of any nature, by you, regarding the same.
You understand and acknowledge that upon using the App, you authorize us to access third party sites designated by you, on your behalf, to retrieve such information requested by you, and to register for accounts requested by you. For all purposes hereof, you hereby grant us a limited powers and hereby authorize us with the full power of substitution and resubstitution, for you and in your name, place and stead, in any and all capacities, to access third party internet sites, servers or documents, retrieve information, and use your information, all as described above, with the full power and authority to do and perform each and every act and thing requisite and necessary to be done in connection with services and facilities available on the App, as fully to all intents and purposes as you might or could do in person. YOU ACKNOWLEDGE AND AGREE THAT WHEN WE ACCESS AND RETRIEVE INFORMATION FROM THIRD PARTY SITES, WE ARE ACTING AS YOUR AGENT, AND NOT THE AGENT OR ON BEHALF OF THE THIRD PARTY. You agree that such third parties shall be entitled to rely on the foregoing authorization, agency granted by you.
You must notify your bank immediately in the event your credit card is lost, stolen, not received, swallowed at an ATM, or is being misused without your permission. Please refer to therefer the detailed instructions received from your bank for additional precautions to be taken in case of loss/ theft/ misuse of your credit card.
You hereby acknowledge and agree that mewt account private ltd. shall not be liable for failure of any transaction undertaken for any reason whatsoever including but not limited to deficiency of service and/or products delivered as well as technical errors. You further acknowledge that mewt account private ltd. shall not be responsible in any manner whatsoever, for any loss incurred by you for a failed/ incomplete transaction undertaken by you using Mewt services.
You hereby agree and express your voluntary, unequivocal and informed consent to your personal data or financial information (including such data as may be designated as ‘personally identifiable data’ under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 or other applicable law), being processed, disclosed and/or transferred by mewt account private ltd. to third-party entities.
All Transactions made or instructions provided through Your Mewt Account on Mewt app shall be deemed to be provided by You. You will be solely responsible for any unauthorised access or use of Your personal or financial information through YourMewt account . To help prevent unauthorised use of your Mewt Account, You should comply with the security measures recommended . If you believe your Mewt Account has been accessed or used in an unauthorised manner, please contact Customer Service immediately.
All electronic communications and content presented and/or passed to us, including that presented and/or passed from remote access connections, may be monitored, examined, saved, read, transcribed, stored, or retransmitted in the course of daily operations by any duly authorized employee or agent of ours in the exercise of their duties, or by law enforcement authorities who may be assisting us in investigating possible contravention / non-compliance with applicable law.
We may monitor your Transactions for high-risk practices or for fraudulent transactions. We may also engage Third Party Providers or other service providers to assist in these efforts and other elements of Mewt Services. If we have reason to believe that there is suspicious or unusual activity being carried out through your Mewt Account , we may temporarily or permanently suspend your access to Mewt Services.
We and/or the Payment Participants may reject a Transaction and/or settlement of payments for various reasons, including but not limited to risk management, suspicion of fraudulent, illegal or doubtful Transactions, selling of prohibited items, use of compromised or blacklisted UPI accounts, Mewt Accounts , chargebacks/complaints or for other reasons as prescribed in the Payment Participant Rules. In the event that a Transaction is rejected or is unable to be completed, we will handle the funds in accordance with Applicable Laws or Payment Participants Rules.In addition, we may take any such action on a Mewt Account as may be required by a statutory or governmental authority or as may be mandated by the respective Payment Participant.
Privacy. You agree and specifically consent that we may collect, store, and use your personal data and any communications made through Mewt App,, in accordance with Applicable Laws and our Privacy Policy.
We may share your payments related information, including UPI Transaction Data, with Merchants, Banks, Third Party Providers and service providers as required for the purpose of operations, settlement payment processing, and promoting Mewt Services.
If you are a Recipient, you agree and specifically consent that Mewt may store your information including bank account number for the purpose of sending you payments.
You agree and specifically consent that Mewt will, through automated means, access your messages on your mobile device/mobile number and retrieve/use information from your messages to provide you with Mewt services. For example: OTP is a one-time password which is provided by your issuing bank in order to carry out the second factor authentication. If you allow us to access your messages, you understand that we may retrieve your OTP from the message received on your mobile device/number and populate and submit the OTP for second factor authentication.
You hereby acknowledge that the deletion of the App from the Device does not constitute termination of your Account and agree to undertake the process detailed herein in order to complete de-registration. If and when you are desirous of having your name and other details removed from the records of mewt account private ltd., immediately upon receiving your written request to that effect, mewt account private ltd. shall remove and/delete all such information. You hereby acknowledge that the removal of your details from the App does not constitute termination of your obligations, if any, to our banking partner with whom your account would have opened.
Communications from or with Mewt . You agree and specifically consent to the collection, storage and use of your information for communications from or with Mewt . You agree and specifically consent that we may, on our own or through third parties, send you emails, SMS or WhatsApp, call using pre-recorded messages or artificial voice, communicate with you through other means, for:(i) providing you with Mewt Services and transactional or account related information;(ii) sending you payment related reminders/updates;(iii) promoting Mewt services;(iv) promoting our Third Party Providers’ services, including any offers or schemes or prizes . These promotions will not use your UPI Transactions Data;(v) promoting new products and activities;(vi) investigating or resolving any product or Mewt Service related concerns including complaints; or(vii) obtaining your invaluable feedback.
In order to serve you better, we may also send you surveys to understand: (i) your experience with our Services, and/or (ii) your needs and requirements.
You certify, warrant and represent that the telephone numbers and/or email addresses and any other information that you have provided to us are your own and not someone else’s and are true, accurate, current and complete. You represent that you are permitted to receive calls at each of the telephone numbers you have provided to us and emails at each of the email addresses you have provided us. You agree to notify us whenever you stop using a particular telephone number(s) and/or email address(es).
All of the content on the App, including, without limitation, all of the page headers, images, illustrations, graphics, audio clips, video clips or text, reports generated, trademarks, tradenames (“App Content"), constitute our and our licensors’ intellectual property. Copyright laws in all applicable jurisdictions protect the App and the App Content.
You may access the App, avail of the features and facilities and utilize the App Content for your personal or internal requirements only. You are not entitled to duplicate, distribute, create derivative works of, display, or commercially exploit the App Content, features or facilities, directly or indirectly, without our prior written permission. If you would like to request permission to commercially exploit any particular App Content, you could contact us in the manner provided for herein.
Mewt account private ltd. and its licensors, if any, are the sole owners of the underlying software and source code associated with the App and all the trademarks, copyright and any other intellectual property rights of any nature in the App.
IN THE EVENT YOU HAVE ANY COMPLAINT AGAINST THE CONTENTS (OR ANY PORTION THEREOF), INCLUDING THAT THE CONTENTS THEREIN ARE INCORRECT OR BREACH THE RIGHTS OF A THIRD PARTY, mewt account private ltd. SHALL TAKE ALL COMMERCIALLY REASONABLE MEASURES TO ADDRESS THE SAME. HOWEVER, mewt account private ltd.’S SOLE OBLIGATION IN THIS REGARD SHALL BE TO REMOVE SUCH CONTENT FROM THE APP; AND THE USER SHALL HAVE NO FURTHER CAUSE OF ACTION AGAINST mewt account private ltd.
You are prohibited from violating or attempting to violate the security of the App, including, without limitation:
You shall not misuse this App by intentionally introducing viruses, trojans, worms, logic bombs or other materials that are malicious or technologically harmful (together "Viruses "). You will not attempt to gain unauthorized access to the App, or any server, computer or database connected to the App. You will not attack this App via a denial-of-service attack. Further, you shall not interfere with or circumvent any security feature of the App or any feature that restricts or enforces limitations on use of or access to the App, such as probing or scanning the vulnerability of any system, network or breach.
Should you breach the provisions of this Clause, you will be liable to be prosecuted under the Information Technology Act, 2000 and other applicable statutes. We will immediately report such breach to the relevant law enforcement authorities and will co-operate with such authorities by disclosing your identity to them. In the event of such a breach, your rights to use this App will cease immediately.
We will not be liable for any loss or damage caused by a denial-of-service attack or Viruses that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this App or to your downloading of any material posted on it.
You agree to immediately report to us all incidents involving suspected or actual unauthorized access, disclosure, alteration, loss, damage, or destruction of data.
You shall not interfere with or disrupt (or attempt to interfere with or disrupt) access and enjoyment of the App by other users or any host or network, including, without limitation, creating or transmitting unwanted electronic communications such as “spam” to other users, overloading, flooding or mail-bombing the App, or scripting the creation of content in such a manner as to interfere with or create an undue burden on the App.
All actions performed by any person using your account and password shall be deemed to have been committed by you and you shall be liable for the same. We reserve the right to suspend/terminate your account at any time if it is found that you have been sharing the password with any unauthorized user.
In order to reduce the risk of unauthorized access, a user is logged out from the account and will have to enter his details and login afresh, after 3 consecutive incorrect login attempts.

The terms of this provision will survive any termination or cancellation of these T&C or your use of the App.
THE SERVICES, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS, AND INFORMATION MADE AVAILABLE ON, PROVIDED IN CONNECTION WITH OR ACCESSIBLE THROUGH THE SERVICES, ARE PROVIDED "AS IS." TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MEWT AND THEIR AGENTS, CO-BRANDERS OR OTHER PARTNERS, INCLUDING BUT NOT LIMITED TO, DEVICE MANUFACTURERS , MAKE NO REPRESENTATION OR WARRANTY OF ANY KIND WHATSOEVER FOR THE SERVICES OR THE CONTENT, MATERIALS, INFORMATION AND FUNCTIONS MADE ACCESSIBLE BY THE SOFTWARE USED ON OR ACCESSED THROUGH THE SERVICES, OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE SERVICES. EACH MEWT PARTY DISCLAIMS WITHOUT LIMITATION, ANY WARRANTY OF ANY KIND WITH RESPECT TO THE SERVICES, NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. MEWT DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE SERVICES WILL BE UNINTERRUPTED OR ERROR FREE. MEWT SHALL NOT BE RESPONSIBLE FOR ANY SERVICE INTERRUPTIONS, INCLUDING BUT NOT LIMITED TO SYSTEM FAILURES OR OTHER INTERRUPTIONS THAT MAY AFFECT THE RECEIPT, PROCESSING, ACCEPTANCE, COMPLETION OR SETTLEMENT OF PAYMENT TRANSACTIONS, P2P PAYMENTS OR THE SERVICES.
THE MEWT PARTIES ARE NOT RESPONSIBLE FOR THE ACCURACY OF ANY PAYMENT INSTRUMENT, INCLUDING WITHOUT LIMITATION WHETHER SUCH INFORMATION IS CURRENT AND UP-TO-DATE. WITHOUT LIMITING THE GENERALITY OF THE PRECEDING SENTENCE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT SUCH INFORMATION IS REPORTED BY THE ISSUER AS OF A PARTICULAR TIME ESTABLISHED BY THE ISSUER AND MAY NOT ACCURATELY REFLECT YOUR CURRENT TRANSACTIONS, AVAILABLE BALANCE, OR OTHER ACCOUNT OR PROGRAM DETAILS AT THE TIME THEY ARE DISPLAYED TO YOU THROUGH THE SERVICES OR AT THE TIME YOU MAKE A PURCHASE OR REDEMPTION. YOU MAY INCUR FEES, SUCH AS OVERDRAFT FEES OR OTHER CHARGES AS A RESULT OF SUCH TRANSACTIONS, PER YOUR AGREEMENT WITH YOUR ISSUER, OR YOUR ATTEMPT TO MAKE A PURCHASE OR REDEMPTION MAY NOT BE SUCCESSFUL.
The App and the functions and features therein are provided on an “as is” and on an “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We shall make reasonable efforts to make available the App and the functions and features at all times. However, we make no warranty that the App shall meet your requirements, be uninterrupted, timely, secure, and/or error free. Further we do not make any warranty as to the results that may be obtained from the use of the functions and features or as to the accuracy, reliability and/or quality of the output derived therefrom.
We shall not be liable for the loss and/or damage of the confidential information or data of the User arising as a result of an event or a series of related events, that is beyond the control of mewt account private ltd., including failures of or problems with the internet or part of the internet, attempted hacker attacks, hacker attacks, denial of service attacks and/or viruses or other malicious software attacks or infections.
Any material downloaded or otherwise obtained through the App is done at your own discretion and risk and you are solely responsible for any damage to your Device or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from us through or from the service will create any warranty not expressly stated in these T&C.
We shall not be liable for any losses and/or damages which may arise as a result of a third party entity’s usage of the USER’s personal data or financial information (including such data as may be designated as ‘personally identifiable data’ under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011).
IN NO EVENT SHALL MEWT BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY UNDER ANY CIRCUMSTANCES FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY, DAMAGES OR LOSSES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES WHICH MAY BE INCURRED IN CONNECTION WITH ANY MEWT PARTY OR THE SERVICES, OR ANY GOODS, SERVICES, OR INFORMATION PURCHASED, RECEIVED, SOLD, OR PAID FOR BY WAY OF THE SERVICES, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF THE MEWT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS. IN NO EVENT SHALL THE MEWT PARTIES' TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATING TO THESE COMBINED MEWT TERMS EXCEED THE NET FEES MEWT HAS ACTUALLY RECEIVED AND RETAINED FROM YOUR VALID TRANSACTIONS DURING THE THREE MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.
Nothing in these Mewt Terms is intended to exclude or limit the liability of any party for (i) death or personal injury; (ii) fraud; (iii) fraudulent misrepresentation; or (iv) any liability that cannot be excluded or limited by law.
You and Mewt acknowledge that each party has entered into these Combined Mewt Terms relying on the limitations of liability stated herein and that those limitations are an essential basis of the bargain between the parties. In addition to and without limiting any of the foregoing, no Mewt Party shall have any liability for any failure or delay resulting from any condition beyond the reasonable control of such party, including but not limited to governmental action or acts of terrorism, earthquake, fire, flood or other acts of God, labor conditions, power failures and Internet disturbances.
These T&C shall apply when you complete the authentication process and create an account and shall remain valid and binding on you for so long as you maintain the Account.
We reserve the right, in our sole and absolute discretion, to suspend or terminate your use of one or more Mewt Services, without notice and without liability to you or any third party, for any reason, including without limitation inactivity or violation of these Mewt Terms or other policies we may establish from time to time. Upon termination, the rights and license granted to you herein shall terminate and you must cease all use of the App.
The Mewt Terms and Policies will be governed by and construed in accordance with the laws of India. You agree that any legal action or proceedings arising out of the aforementioned documents may be brought exclusively in the competent courts/tribunals having jurisdiction in Bengaluru, India and irrevocably submit themselves to the jurisdiction of such courts/tribunals. You understand that We may need to share information that you provided on Mewt Account in order to satisfy applicable law, regulation, legal process or an enforceable governmental request.
We have the right, in our sole and absolute discretion, to change, modify, or amend any portion of the Mewt Terms at any time. The changes will become effective, and shall be deemed accepted by you, after the initial posting and shall apply on a going-forward basis with respect to transactions initiated after the posting date. In the event that you do not agree with any such modification, your sole and exclusive remedy is to terminate your use of the Services.
In addition, we reserve the right at any time to modify or discontinue, temporarily or permanently, the Mewt Services (in whole or in part) with or without notice. We may also change the Services, including applicable fees, in our sole discretion. If you do not agree to the changes, you may stop using the Services. Your use of the Services, after implementation of the change(s) will constitute your agreement to such change(s). You agree that we shall not be liable to you or to any third party for any modification, suspensions, or discontinuance of the Services.
These Terms and any rights and licenses granted hereunder, may not be transferred or assigned by you. We may assign, in whole or in part, the benefits or obligations of this Agreement. We will provide an intimation of such assignment to you, which will be binding on the parties to these Terms and Conditions.
Unless otherwise expressly stated in this Agreement, the failure to exercise or delay in exercising a right or remedy under the Mewt Terms and conditions will not constitute a waiver of the right or remedy or a waiver of any other rights or remedies, and no single or partial exercise of any right or remedy under the Mewt Terms will prevent any further exercise of the right or remedy or the exercise of any other right or remedy.
Any failure on the part of Mewt Account Private Ltd. to require performance of any provision of these T&C shall not affect its right to full performance thereof at any time thereafter, and any waiver by Mewt Account Private Ltd. of a breach of any provision hereof shall not constitute a waiver of a similar breach in the future or of any other breach.
The terms and provisions of the Mewt Terms, which by their nature and content are intended to survive the performance hereof by any or all parties hereto will so survive the completion and termination of this Agreement.
If any provision of the Mewt Terms is or becomes, in whole or in part, invalid or unenforceable but would be valid or enforceable if some part of that provision was deleted, that provision will apply with such deletions as may be necessary to make it valid. If any court/tribunal of competent jurisdiction holds any of the provisions of the Mewt Terms unlawful or otherwise ineffective, the remainder of the Mewt Terms will remain in full force and the unlawful or otherwise ineffective provision will be substituted by a new provision reflecting the intent of the provision so substituted.
